| 摘 要： | 无论是对于刑法总论,还是对于刑法分论,情节犯无疑都是一个"麻烦的制造者".麻烦之一是,情节犯本身的界定就是一个长期聚讼不已的理论难题;麻烦之二是,情节犯在故意的认识内容、转化犯等方面都对现有的刑法理论构成了严峻的挑战,以至于人们不得不予以正视并设法加以解决.

| Abstract: | Both to the general theory and to the special theory of the Criminal Law,the circumstance crime must be a "troublemaker".One trouble is to define itself;the other trouble is that it makes a great challenge to the theory of the Criminal Law in the question of cognition of criminal intention and the transformation crime.The challenge is so serious that we must envisage it and try to resolve it. |
