| 摘 要： | 我国高等教育的快速发展,要求在理论上和立法上对于学校与学的关系作出更清晰、更准确的界定,本文分析、总结了我国立法和司法实践中对于校生之间法律关系的认定,指出了的两者的特点、差异及其各自的缺陷,并提出了校生关系的性质及立法上对之应持有的态度.

| Abstract: | The rapid development of higher education in China requires a theoretical and legal definition of the relationship between universities and their students. This paper summarizes several theories on the matter abroad, examines the features of, the differences between, and the respective defects of current Chinese statutes and judicial practices of the relationship definition, and proposes the proper way the law should follow to deal with the matter. |
