| 摘 要： | 我国《票据法》对票据丧失规定了挂失止付、公示催告、提起诉讼三种补救措施供失票人选择。"提起诉讼"是一种无法操作的措施,笔者认为,有必要对其补充解释,应将英美法系提起诉讼中失票人通过提供担保优先实现票据权利的优点吸收入公示催告中以克服其局限性,提起诉讼仅适用于失票人知悉票据在何人之手的情形。

| Abstract: | The Commercial Instrument Law of China provides three remedial measures for the loss of the commercial instruments for the losers' choices. Instituting a proceeding, though, is actually impossible in this respect. The author holds that it is necessary to provide a supplementary interpretation. In the Anglo-American Law System, losers can fulfill their right of bill by providing guarantees, which should be introduced into the public summons for exhortation to restrict its disadvantage. |
