论我国民事简易程序的再简化

就我国现行简易程序立法的司法实践来看,简易机制还很缺乏,其简化尚不充分。因此,我国民事简易程序有进一步简化的必要。具体可以从设立专门适用民事简易程序的机构和人员、实行限制性书面审理、完善民事诉讼送达制度、缩短审理期限、简化裁判文书的制作、简化简易案件二审程序六个方面进行简化。

On Further Simplification of the Civil Summary Procedure in Our Country

Seen from the judicial practice of our country'current summary procedure legislation,the simplification mechanism is inadequate and not fully developed.Therefore,it is necessary to further simplify our country's summary procedure.The simplification maybe achieved from six aspects:to set up special institute and staff for the civil summary procedure;to carry out restrict written trials;to perfect the delivering system of civil litigation;to shorten the limit of trials;to simplify the making of the adjudication document;to simplify the second trial process of simple cases.
