| 摘 要： | 文章在综合分析的基础上指出，高等教育合同有其特定的含义，其在本质上是民事合同，应归入民法范畴，亟待在《合同法》中明确规定高等教育合同一章，从而对高等教育合同进行有效的规范与调整。

| Abstract: | On the basis of comprehensive analysis,the author thinks that the higher education contract has its own definition.Essentially,higher education contract is the civil contract.In view of the law reality of the higher education contract,it is necessary to rule definitely the chapter of higher education to make a good norm and regulation on higher education contract. |
