中国法学民间法路向的意义指向

现时的中国法学正行进在多元路向上。民间法是法律的社会化阐释方式,一方面作为法律多元之一而有益于法律的多元本质阐释,另一方面作为法律与社会的媒介方式而有益于解决法律内部的逻辑证成困境和实现作为规则化治理事业的法治的目标。民间法要以法源等方式和途径在制定法中凸现自身的存在和价值,才能益于作为规则化治理事业的法治的实现。

The Significance of the Orientation to Folk Law in Chinese Science of Law

Chinese science of law is progressing toward the multi-way nowadays.As a socialization way for the interpretation of law, or one kind in the law,the folk law helps to interpret the essence of the law. Moreover,as a media connecting law and society,the folk law is favorable to resolve the logical dilemma and to realize the aim of rule of law as the governance characterized by regulation.The folk law should occupy by way of sources a prominent position in positive law,so it can be beneficial to the realization of rule of law.
