| 摘 要： | 知识产权作为一个集合概念出现具有很强的历史偶然性,随着技术的发展和其他辅助手段在知识产权公示中发挥的作用逐渐增强,知识产权本身也在不断发生着变化。知识产权客体的不断突破,主体呈现多元化,权利内容持续扩张,管理模式的演进,知识产权法哲学的嬗变反映了变革中的知识产权制度发展脉络,知识产权立法和政策的制定要充分考虑这些因素并予以回应。
