环境权的私法规制初探

我国环境权的私法规制存在诸多不足,现有私法对环境权公益性的保障不足,缺少利益协调具体制度,对环境权保护的客体范围无法涵盖环境和环境要素,现有物权法难以满足环境权的保护要求,现有侵权法难以提供环境权预防性保护,现有人格权法难以满足对环境人格利益保护的要求.我国对环境权的私法规制,需从构建环境物权及其他物权的生态化、构建环境合同及合同的生态化、构建环境人格权等方面加以完善.

On Private Law Regulation of Environmental Right

The realization of the environmental right needs to use the private-law means.China''s private law regulation of environmental right has many disadvantages,the existing private law does not have enough protection for public welfare of environmental right and lack of the interests coordination institution,and its protection of the object of environmental right can not contain environment and environmental factors,the existing property law is difficult to meet the protection requirements of environmental right,the existing tort law is hard to provide the preventive protection of environmental right,the existing personality right law is difficult to meet the protection of environmental personality interests.In China,the private law regulation of environmental right can be perfected from constructing the ecologization of environmental property right and other property rights,building the environmental contracts and ecologization of environmental contract and the environmental personality rights.
