论船员劳动的特点

用马克思主义哲学的方法分析了船员法所赖以建立的基础——生产力和生产关系的特殊性,主要包括船员劳动力的特殊性、船员劳动关系的特殊性和船员劳动过程的特殊性,结论是船员劳动在劳动者的劳动能力方面、劳动关系中主体双方的权利和地位方面、劳动过程中各种生产要素进行结合并形成产品——海运服务的过程方面,都具有不同于一般陆上劳动的特殊性,因此,用于调整一般陆上劳动关系的劳动法不适应船员劳动关系调整的需要。在我国为了保护海上劳动者——劳动权利,促进海运业的发展,必须制定作为劳动法之特别法的船员法。

On the characteristics of the seaman labor

The article analyzes the foundation of enacting crew law based on the Marxist philosophy-the specialty of the productivity and the production relations, mainly including the specialties of seaman labor, labor relations of seaman and labor process of seaman, and draws a conclusion that seaman labor is very different from the general labor on land in the aspects of the labor ability, both parties' rights and position in the labor relation and the labor process in various production factor that carries on combining and becoming the product-sea transportation service. Therefore, labor law used for adjusting the general labor relation on land,is unfit for the demand of the seaman labor relation adjustment. In order to protect the rights of laborers of mariners and prompt the development of marine industry, we should enact the special law of the labor law-the crew law.
