刑事电子数据跨境取证管辖问题研究

电子数据跨境取证模式目前主要有数据存储地模式和数据控制者模式,若两种模式不加改变,单一适用于我国司法实践皆存在种种不足.现从技术角度对网络空间与现实空间进行划分,确立"物理层"之上作为网络空间的取证管辖领域;以属人管辖为理论基础,采用网络用户及其行为作为判断取证对象的基准,确立网络最小管辖单位;在明确取证边界与取证对象的基础上,发展成为"网络最小单位管辖模式".确立"数据存储地管辖模式为主,网络最小单位管辖模式为辅"的取证管辖模式,对于维护网络空间主权、消除单边取证风险、制衡数据大国长臂管辖具有重要的意义.

Research on Cross-border Forensic Jurisdiction Model of Criminal Electronic Data

At present, there are mainly two modes of electronic data cross-border forensics:data storage location mode and data controller mode. If the two modes are not changed, there are all kinds of shortcomings when they are applied to China''s judicial practice. This paper divides cyberspace and real space from the perspective of technology, and establishes the "physical layer" as the forensic jurisdiction of cyberspace. Based on the theory of personal jurisdiction, the network users and their behaviors are used as the benchmark to judge the objects of forensics. Therefore, the minimum jurisdiction unit of network is established. On the basis of clarifying the boundaries and objects of forensics, it can be developed into the "network minimum unit jurisdiction mode". Cross-border forensics of electronic data in China should finally establish the mode of "the jurisdiction mode of data storage place as the main, and the jurisdiction mode of the minimum unit of the network as the auxiliary". It is of great significance for safeguarding the sovereignty of cyberspace, eliminating unilateral forensics risks, and balancing the long-arm jurisdiction of data powers.
