中国经济法学的发展历程与展望

中国经济法学经过26年的发展,走过了探索期,与市场经济发展适应期,并迎来了进一步发展的重要历史时期;其基本经验就是与改革同行,理论联系实际;在法域范围、价值所在、适度性原则、综合性功能、渊源特征方面基本取得了共识;在当前及今后主要面临宪法地位问题、基本法的制定问题、实践基础问题、中观经济法理论创立问题以及教育完善问题,而对这些问题的探讨与逐步解决,正是今后中国经济法学发展的努力方向。

The Development Process and the Outlook of the Study ofChinese Economic Law

During 26 years development,the study of Chinese economic law has passed through the exploration time and its adaptation to market economy,and has welcomed the important historic period to make further development.Its basic experience is to go together with reform and to integrate theory with practice.Now a consensus has been reached on the law region range,the value location,the principle of moderation,the comprehensive function and the origin characteristics.The probems we will be confronted with are the constitution position,the formulation of fundamental law,the practice foundation,the establishment and the perfection of the theory of the medium economic law.The discussion on and the solution to these problems is the direction of the study of the Chinese economic law.
