行政自由裁量权具有双重功能 ,它在运作中的“自由性”和“封闭性”特点决定了它更易受权力、金钱等非客观因素的影响而导致枉法、滥用自由裁量权 ,这严重影响了法律适用的公正和准确。为此 ,必须大力加强立法 ,加大对自由裁量权司法审查的范围和深度 ,严格对执法者的考核任免和责任追究制度 ,完善行政法制监督 ,确保行政自由裁量权合理有效的行使

Legal Control over the Abuse of Administrative Discretion

The present paper maintains that the ambiguous nature,as is embodied in its flexibility and isolated operation,of administrative discretion entails its being subjected to power play and mercenariness,and thus is likely to lead to its abuse and unjust manipulation of the law.The author therefore advocates reinforcing legislation concerning the range and depth of administrative discretion,tightening appointment regulations,and improving administrative supervising system so as to ensure the effective operation of the discretion.
