| 摘 要： | 随着市场经济的日益发达 ,商誉侵权行为的方式和手段也日益繁杂和隐蔽 ,对商誉侵权行为的构成要件应重新认识 :商誉侵权的主体认定———不限于经营主体 ;商誉侵权的主观要件———不限于故意 ;商誉侵权的客观方面———不限于“虚伪事实”。

| Abstract: | With the development of the market economy, the manners of goodwill infringement are becoming more and more miscellaneous and undiscovered. So we should re-understand the constitution factor: the subject of goodwill infringement is not limited to management subject, the subjective aspect of goodwill infringement is not limited to intention, and the impersonal aspect of goodwill infringement is not limited to false fact. |
