政府采购法中的采购行为博弈分析

在市场经济社会中,市场主体的经济关系不仅是竞争,更重要的是合作。合作比不合作在一定程度上更有效益。法律制度是个人理性与集体理性相互经过多次博弈达成的一系列契约的总和。如果说法律制度的安排为各市场主体合作提供了一个基本框架,那么政府采购法律制度则主要是为采购实体、财政官员及供应商的合作创造了条件,保证这种合作的顺利进行。文章运用博弈模型,分析我国建立政府采购法律制度的必然性,并对《中华人民共和国政府采购法》的现实作用进行了探讨。

The Game Analysis of Purchase Action in the Government Purchase Law

In the society of market economy,the economic relation of the market subject is not only a competition,but also a cooperation.Cooperation is on the certain degree more beneficial than noncooperation.The law system is a contractual total in a series that personal reasonableness reaches through many games with collective reasonableness mutually.If the institutional arrangement in law is to provide a basic frame for each market to be cooperated, the government purchase law system and then is to create the cooperative conditions for the buying entity, public finance official and supplier primarily,to guarantee this kind of cooperation to smoothly progress.This paper makes use of the game model to analyze the inevitability of establishing the government purchase law system in our country,and probes into further the study of the realistic function of the governmental procurement law of the People's Republicof China.
