上合组织反恐法律机制建设研究

上合组织反恐法律机制是区域国家组织主导的区域反恐的制度依据。在治理中亚恐怖主义犯罪的问题上,由反恐法律机制指导的上合组织反恐斗争取得了显著的成效。但随着恐怖主义的新一轮发展,需要上合组织发挥更大的作用,已有的反恐法律机制体现出不足。对比联合国和其他区域组织的反恐法律机制,上合组织反恐法律机制还存在对恐怖主义犯罪的界定上不清晰,在反恐刑事司法合作方面亟待完善等问题。对此,可以借鉴全球性、区域性国际组织的成熟经验,结合本地区实际情况,完善上合组织反恐法律机制。同时,在反恐法律机制建设的路径中,应强调对平民的人权保障、解决地区经济发展中遇到的问题,从根源上铲除恐怖主义滋生的土壤。 

Study on the Establishment of the SCO Anti-terrorism Legal Mechanism

The SCO anti-terrorism legal mechanism is the institutional basis for regional anti-terrorism led by regional state organizations.On the issue of the terrorist crimes in Central Asia,the SCO's anti-terrorist fights guided by the anti-terrorist legal mechanism has achieved remarkable results.However, with the development of terrorism, it is necessary for the SCO to play a greater role,and the existing anti-terrorism legal mechanisms are inadequate.Comparing the anti-terrorist legal mechanisms of the United Nations and other regional organizations,the SCO's anti-terrorism legal mechanism is not clear on the definition of terrorist crimes, and urgently needs to be improved in counter-terrorism criminal justice cooperation.In this regard, we can learn more mature experiences from global and regional organizations,and combine the actual situation in the region to improve the SCO's anti-terrorism legal mechanism.At the same time,in the path of the construction of the anti-terrorism legal mechanism,we should emphasize the protection of the human rights of civilians, solving the problems encountered in regional economic development,and to root out the roots of terrorism.
