建立健全网络反腐法律制度论要

近年来,网络反腐尽管发挥了明显的正能量和正效应,但是仍然存在不少局限性和负效应.法律制度不健全不完善,是导致网络反腐局限性和负效应产生的重要原因之一.法律制度的建立健全是新时期网络反腐健康发展的根本保障.建立健全网络反腐的法律制度,既要坚持审慎适度和循序渐进相结合、规范权力监督主体与规范权力行使主体相统一、“网上立法”与“网下立法”相配套、“废”“改”与“立”相衔接等基本原则,也要抓紧运作网络反腐旧法的修改和新法的制定等基本内容.

There are some basic principles which should be adhered for the establishment and improvement of the legal system of the network anti - corruption, including the combination of moderate prudence and stable pro- gression, the unity of ruling the power supervisors and power holders, the matching of ＂online legislation＂ and ＂off - line legislation＂ , the convergence of the ＂abolishment＂, ＂change＂ and ＂legislation＂. At the same time, we should pay attention to modify the old laws and make new laws for the network anti -corruption.
