论法的正义价值及其实现路径

古往今来的思想家们虽然对正义有不同的认识,但追求和实现法的正义则是他们共同的追求和理想。在马克思主义看来,作为法的最高价值的正义,既是抽象的,又是具体的、历史的。正义不仅与秩序、平等、自由和效率密切相关,而且是秩序、平等、自由和效率等具体价值的统摄和抽象。法的正义价值是通过人们的法律实践来实现的,是法的价值主体作用于法的价值客体,从而使作为客体的法所具有的潜在的、内在的正义价值转化为现实的和外在的正义价值,对主体产生应有或期望意义的过程。

On Justice Value of Law and Its Path to Achieve

Thinkers of all ages hold different ideas about justice,but they share common pursuits and ideals about the realization of the justice of law.In the opinion of Marxism,justice,as the highest value of law,is abstract as well as concrete and historical.Justice is not only closely related to,but also is the consolidation and abstraction of order,equality,freedom and efficiency.The justice value of law is achieved through people’s legal acts.It is a process in which the value subject of law makes an impact on the value object of law,and hence turns the potential and intrinsic justice value to realistic and external justice value and causes expected significance for the subject.
