| 摘 要： | 基于国际私法所追求的确定性和公正性价值之间的矛盾，指出只有将这两个价值拆分适用于国际私法的不同阶段才有可能从根本上解决两者之间的矛盾。法的外在品质的要求决定了立法阶段应强调法的确定性。司法过程的个案针对性及司法过程大量法律方法的适用决定了司法过程应着重法的公正性。

| Abstract: | Based on the contradiction between both definition and justice values that international private law pursued,the paper pointed out that only by applying these two values to different phases of international private law respectively,the contradiction can be solved fundamentally.Exterior character of law determines that definition should be emphasized in legislation process.Direction of each case and applying of many law methods to it in judicial process determine that judicial process should emphasize justice. |
