构建中国碳排放权交易机制的法律政策思考

虽然2009年12月19日的联合国气候变化大会达成了《哥本哈根协议》,但该协议不具法律约束力,且未解决2013年后全球温室气体减排的实质性问题。2013年后温室气体减排的走势也因此变得扑朔迷离。为了避免中国企业利益在国际贸易中受到损害,中国企业除了在国际贸易谈判中要谨慎之外,中国政府应参考、借鉴欧盟碳排放权交易机制,从法律和政策的角度深入研究中国碳排放权交易机制的设立目的、碳减排目标、交易的对象、交易的配额、机制运行时间、交易所的设置等问题,为中国日后顺利进入全球碳排放权交易市场做好充分的法律政策准备。
