| 摘 要： | 本文认为探矿权的客体是特定的物——特定工作区及其地下构成物,而不是一种智力成果。探矿权是由矿产资源法规定的、在矿产资源国家所有权之上设定的、从矿产资源国家所有权中派生出来的、并相对独立于矿产资源国家所有权的限定性物权,探矿权人仅享有对矿产资源进行勘查并由此获得收益的权利,探矿权是他物权,而且探矿权又是他物权中的用益物权。明确探矿权的用益物权属性,为我们进行探矿权立法提供了法理基础;也为管理探矿权的地质矿产行政机关加强和改善探矿权管理以及制定相应的促进探矿业发展的经济政策提供了法律依据。

| Abstract: | This article holds that the object of prospecting right is specific thing-specific working area and its underground composition and is not intelligent achievement.The prospecting right is stipulated by minerals law,established on the mineral resource property rights of the country,derived from the mineral resource property rights,and is independent from the mineral resource property rights.Prospecting right is a kind of definite right and the person who holds it only has the right to prospect the mineral resources.It can provide us with the law foundation for the legislation of the prospecting right as well as the principles of the improvement on the management through the research on the legal characteristics of the prospecting rights. |
