| 摘 要： | 从"个人"和"集体"两个概念的逻辑关系角度切入立法程序民主问题,挑战了传统立法理论关于立法的价值基础和标准的观念,提出"个人利益"而非"公共利益"是立法的价值基础和标准,并以此为理论预设,利用公共选择理论的研究方法从理论和实践的角度分析影响立法程序民主和个人利益实现的内在、外在的诸多因素,进而指出立法民主的可能性及其限度,最终从方法论、立法技术、立法程序、法学家使命等几个方面,提出了缩小立法理念和立法实践差异的思路.

| Abstract: | Based on the analysis of the logical relation between the individual and collective,the article has challenged the conception of the traditional legislative theory about the standard and the fundament of value,and put forward that the individual interest is the very standard and the fundament of value.Under this theoretical presupposition,the article has explored the internal and external factors influencing the legislative procedural justice and individual interest from the angle of practice and reality with the methods of the theory of public choice,furthermore posed the possibilities and limits of the legislative justice.Thus as a result,the article advanced the suggestion for reducing distinguishes between the legislative conception and reality. |
