一元还是多元——论家庭暴力女性受害者的权利救济途径

作为家庭暴力的主要受害者,女性“以暴制暴”的反抗,实际上是在现代社会公力救济之外出现的一种报复性的私力救济现象。要排除这种非理性的报复,就必须发展和完善受虐妇女的权利救济的能力,这种能力的完善一方面依靠公力救济对她们的支持;另一方面,应当通过制度构建和制度创新实现有组织的权利救济。

Monism or Pluralism: On the Methods of Rights Remedy for Female Victims of Domestic Violence

As the victims of domestic violence, women's resistant behavior is a kind of retaliatory self-help. If we would like to help the female victims get rid of the irrational retaliatory conducts, we should develop and perfect the ability of rights remedy for them. On the one hand, the perfection of the ability depends on the remedy; on the other hand, we should construct self-organized rights remedy of female victims by system construction and innovation.
