论土地用益物权制度的三种研究视角

土地用益物权制度的研究在当前中国具有巨大的现实意义和实践价值,对相关研究视角与方法的思考更是科学解读该问题的关键与核心。目前,学界关于该问题的研究视角主要包括传统法学视角、传统经济学视角和法经济学视角。传统法学视角关注该制度在规范层面的理解和运用;传统经济学视角重视对该制度的绩效进行经济分析;而法经济学视角由于实现了实证分析与规范分析的结合,静态分析、比较静态分析与动态分析的结合,图表分析与案例研究的结合,比较制度与历史分析的结合,故而取得了研究视角和方法上的突破与超越。

On Three Research Perspective as to the Usufruct of Land Immovables

The research about the usufruct of land immovables in China has enormous practical value and significance.The research perspectives and thinking patterns are the key to scientific interpretation of the problem.Currently,the academic perspectives on the issue are traditional legal perspective,the conventional economic view and the view of law and economics.The traditional legal perspective concerns the understanding and application of the system specification;the conventional economic view refers to the economic analysis of the system＇s performance;the view of law and economics surpasses the traditional research perspectives,because it achieves the combinations of empirical and normative analysis,static and dynamic analysis,graph analysis and case study,and systematic comparison and historical analysis.
