| 摘 要： | 论述了儒法思想的产生、冲突和法宗思想在秦国的推行并获得成功的原因 ,同时通过讨论法家思想在婚姻制度这一礼制核心上的体现 ,认为“法治”有优于“人治”的方面 ,中国古代有过崇尚“法治”的传统。

| Abstract: | The generation of and conflicts between Confucianism and Legalism were demonstrated, the application of the Legalist ideas in the State of Qin and the reasons for its success were analyzed, and the reflection of the Legalist thought in marriage system was discussed. The authors believed that nomocracy was once advocated by the people in the ancient times. |
