自然正义的当代命运--奥特弗利德·赫费对自然法的辩护和重构

自然法思想在西方传统中有着重要地位,然而19世纪却衰落下来,直到二战后特别是近20年来才得到新的发展。赫费是当代自然法的代表,他消解了对于自然法的种种批评与指责,同时提出了自己“批判”的自然法概念亦即政治的正义性,以此他对自然法进行了重构。自然法在他所提出的三个约束力层次中居于最后的也是最高的层次即道德层次。他认为,鉴于自然法思想的复杂性,可以把它本身分为三个层次来研究。这就是他对自然法的重构。

The Fate of Natural Justice--On the Defense and Reconstruction of Natural Law by Otfried Hoeffe

Natural law plays an important role in the western tradition.But in the 19th century it went down.After the Second World War it revived.Its contemporary representative is the German professor,Otfried Hoeffe,who took action in defense of the natural law and reconstructed it on the new ground.He took to the removal of all kinds of criticisms and condemnation against the natural law,and proposed his own "critical" concept of natural law,which was termed as political justice.It laid on the third stratum in his three evaluation strata and the natural law itself can be differentiated as three strata in study to overcome its complexity.Thus the natural law was reconstructed.
