| 摘 要： | 文章详细分析了生物与遗传资源权同时具有的人权、主权、公权与私权等四个方面的权利属性和不同权利属性之间可能发生的冲突。以此为基础分析了我国现有法律制度对生物与遗传资源保护的不足之处．指出应当建立以专门保护生物与遗传资源的特别立法为核心的综合法律体系。
