| 摘 要： | 减刑作为在刑罚执行中一种有条件的减轻罪犯刑罚的制度,充分体现了我国刑法中惩罚与教育、改造相结合的刑事政策,在加速罪犯改造过程中起到了一定的积极作用。但减刑制度本身存在一定的弊端,会使一些主观恶性深、人身危害性大的罪犯通过伪装的良好表现获得减刑,提前重获自由,给社会带来了极大的不安定因素,使得减刑在鼓励罪犯改造的功能方面将大打折扣。文章试图通过论述修改现行刑法有关减刑适用对象来克服减刑的弊端。

| Abstract: | commutation,as a system of conditionally reducing punishment in the implementation,fully embodies the criminal policy combining punishment and education and reform,and plays a positive role in accelerating the process of transforming criminals.But commutation system itself has some drawbacks which make malignant criminals regain freedom in the guise of good performance in acvance.This brings about tremendous factors of instability and makes commutation less drffective.The author tries to overcome the draw backs of commutation by demonstrating aplication objects in amending the existing criminal law. |
