| 摘 要： | 数据库的法律保护问题已经成为知识产权领域的一个重要课题,而数据库是否具有原创性,决定了对数据库的不同立法保护模式,具有原创性的数据库受版权保护,不具有原创性的数据库的法律保护在国际上还没有一个统一有效的模式。通过对国际上非原创性数据库法律保护的理论及立法实践的进展进行跟踪,分析利弊得失。

| Abstract: | Problems about database legal protection have become an important problem of intellectual property rights.But whether the database has originality decide the protection pattern of the database different legislation.The database which has originality is protected by the copyright.The one which has not originality hasn't an unified standard in the world.Following the tracks of the theory about the law protection of non-originality database and the progress of legislation practice,the advantages and disadvantages are analysed. |
