| 摘 要： | 鉴于配偶在家庭中的重要作用以及在法定继承关系中法律地位的增强,我们对各主要国家及中国四法域的相关法律规定进行考察,明晰其异同.并在比较基础上.借鉴他国立法经验,从配偶的法定继承顺位、法定继承份额以及配偶之"先取权"和"用益权"几点出发,完善我国的配偶法定继承权,以实现对配偶继承利益的保护,彰显法律在婚姻家庭领域的公平与正义.
