非法转让、倒卖土地使用权罪探析

非法转让、倒卖土地使用权罪是1997年刑法新增的罪名,并存在多个立法和司法解释。刑法学界对本罪的概念、犯罪客体、非法转让等存在不同争议。笔者在分析的基础上提出了完整的概念,认为犯罪客体是简单客体,可以从不同角度进行表述,阐明了非法转让与倒卖的关系,并提供了实践中对本罪的认定。最后笔者认为预防本罪应以解决我国现存土地使用权的管理制度为着眼点。

Probe into illegal transference and scalp of land-use right

This is a new crime added by Criminal Law of 1997.There are several legislative and judicial interpretation for it.Different arguments exist about the conception,objection of crime,illegal transferation,etc.in the circle of Criminal Law. On the basis of analysis, the author provides a complete conception of this crime, thinks that the objection of this crime is a simple objection which can be expressed in different angles, points out the relations between illegal transferation and scalp, and poses the finding means in judicial practice. Finally the author believes that the solution and change of administrative system of land - use right inforce in our country is a key of prevention of this crime.
