| 摘 要： | 中西方法律中都有关于容隐制的具体规定。容隐制乃是“缘人情而制”，日常生活中的容隐现象具有普遍性。容隐制的确立，既是对人类感情的尊重，又是对生活实情的顺应。而大义灭亲的行为由于违背“人情”，并不具有可行性。

| Abstract: | In the legal frame of orient and occident, there are particular rules on concealment system. Concealment system is based on the relative sensibility, and the concealment phenomena are universal in our daily lives. The establishment of concealment system not only esteems human feelings, but also humors living fact. Therefore place righteousness above family loyalty is not feasible, because this behavior disobeys human sensibility. |
