比例原则与权力之治

在学者的研究当中,多将比例原则作为行政法的一个原则,或者是行政程序法的基本原则。事实上,鉴于资源的有限性、国家权力运作的效率以及对公民权利的保护,比例原则不仅仅是行政法上的一个原则,而且也是宪法层面上的一个重要原则,宪法的许多条文的规定都蕴涵和体现了这一原则。它不仅约束公民,要求公民自身不得滥用宪法所规定的基本权利,更制约国家权力,要求国家权力也不得滥用,否则,有违国家产生的目的。

The Principle of Proportion and Regulation of Power

Many experts look on the principle of proportion as a principle in the administrative law, even administrative procedure law in their researches. In fact, the principle of proportion is not only a principle in administrative law, but in the Constitution, whereas resources are limited, and the powers must pursue and realize efficiency, and protect the rights of citizens. Many clauses in the Constitution contain or embody this principle. It restricts citizens, and requests them not to abuse their rights prescribed in constitution. It is most important that the principle of proportion restricts state, and requests them not to abuse their powers or else they will disobey the goal for which the state came into being.
