河北省地方环境立法的现状、问题与对策

地方特有的环境问题需要地方环境立法创制适合区域特点的环境保护措施,因此,对地方环境立法进行实证研究具有现实意义。目前,河北省地方环境立法数量超前、注重废改立并举、立法领域宽泛且不断前行,但存在诸如人大立法主导性被削弱、立法项目不均衡、公众参与有限等问题,建议界定地方立法权限、强化政府责任和公众权益、引导公众参与立法等,以促进河北省地方环境立法实践。

Present Situation, Problems and Countermeasures to Environmental Legislation in Hebei Province

Local peculiar environmental problems need local environmental legislation for creating environmental protection measures appropriate to regional characteristics,so an empirical research has a practical significance.At present,Hebei environmental legislation advances in quantity and pays attention to waste change simultaneously,and the legislative field is broad.There also exist problems such as the National People＇s Congress legislation is weakened and the project is not balanced and public participation is limited.Suggestions are proposed that legislative competence should be defined,the government responsibility and public interests should be sthengthened and the puhlic should be guided to participate in legislation to promote legislation practice.
