论转型期政府权力的规范——基于经济法视域的思考

国家干预经济的行为理应以社会整体利益为导向。然而，现存的国家干预经济的行为却会因“政府失灵”，导致干预的功能失调和效用消减，这就使得控制政府权力成为必要。中国政府的权力要得到规范与控制，应当在既有的30年强计划经济路径依赖中进行考量。否则，其产生的论证基础会发生更深层次的位移。现代市场经济的关键就是通过法律划定政府的权力边界，规范政府对市场的干预。将政府自身的寻租利益限制在最小的范围之内，将最大的利益资源留给市场主体，给予公民。只有这样，回归政府应然的角色，以促进社会整体利益的实现。
