媒介权力与司法监督

媒介因其传播的工具性资本而拥有一种软权力得以与其他社会权力相抗衡。我国的大众传媒作为党政喉舌和舆论工具,带有更大的权力效力,从而能够对司法进行有效监督。媒介利用掌握的传播"话语权",并通过"议程设置"、"把关人"等运行机制,对权力对象的活动实行监控。媒介权力如同一把双刃剑,其合理的监督有助于提高司法的公正性及透明度;而监控不当与超载越权则会影响司法公正。我们应该保证司法和媒介在体制上的独立,以实现媒介监督与司法公正的平衡。

The Media Power and the Judicial Supervision

Due to the spread instrumental capital, the media has a soft power that can match any other social powers. That's why our mass media, as the mouthpiece of the Party-and-government, can be successful in the judicial supervision. Just like a two-edge sword, the media power can ensure the fairness of judicature or break the fairness of judicature if proper or improper supervisions. So we should establish the independence of the media and judicature and keep a balance between the media supervision and the judicial impartiality.
