行政自由裁量权控制问题论析

自由裁量权是一项重要的行政权力。现代社会，行政自由裁量权的存在为行政效率所必需。然而，其固有特征导致了其侵犯行政相对人权益的危险，必须对行政自由裁量权进行必要的控制。从立法和司法途径对行政自由裁量权进行控制，可以避免权力的滥用，保障行政权力的有效运作和行政相对人合法权益的有效维护，推动依法行政和依法治国的进程。

Studies on the Control of Administrative Discretion

The administrative discretion is an important administrative power. In modern society, it is necessary for the administrative efficiency to refer the administrative discretion, while the power tends to encroach the rights and interests of the administrative relative persons because of its inhere character, so we have to take an essential control of it. This paper expatiates the concept of the administrative discretion and clarifies the principle it should abide by. On this foundation, the author brings forward methods to control the administrative discretion in legislative and judicial way, avoiding the abuse of power, in order to ensure the efficient performance of administrative power and maintenance of the legal right of relative persons and promote the tenor of administration according to law and the rule of law.
