论合同效力的扩张

工业革命和现代科学技术的进步 ,使现代社会物质生活关系发生巨大改变。为了协调各种新型社会矛盾和冲突 ,立法者开始注重道德规范的调整作用 ,从而使诚实信用原则在协调当事人利益和社会利益方面的作用得到强化。合同效力扩张的“原动力”是诚实信用原则。合同效力扩张不仅表现为合同效力范围的扩张 ,而且表现为合同效力内容的扩张。并结合传统合同法理论和我国现行法律规定 ,对合同效力扩张的各种表现进行了具体研究

The author believes that,with the development of industrial revolution and modern science and technology,the material living relatcionship in society has changed greatly.In order to coordinate all kinds of social contradictions and conflicts,the legislators begin to pay attention to the regulatory function of ethical norms in regulating.By doing this,the effect of the principle of good faith has been strengthened in regulating the benefits of the parties concerned and those of society.The motive force of expanding the contract validity is the principle of good faith.The expansion of contract validity is not only embodied in the expansion of the limits of contract validity,but also in its content.The author made a detailed study of all kinds of expressions of contract validity on the basis of the traditional contract law theory and decrees in force in China.
