论拍卖师的注意义务

拍卖师对委托人负有根据委托人的指示行为,对拍卖物做准确描述,不得以低于保留价的价格出卖拍卖物,与买受人订立具有约束力的合同并取得价款,保管拍卖物等的义务以及忠实义务和保密义务;对竞买人和买受人负有拍卖物瑕疵说明义务,保证公平竞争的义务,交付拍卖物并转移所有权的义务,瑕疵担保义务;对第三人负有尊重其所有权和其他权利的义务,安全保障义务。

On the duty of care of an auctioneer

An auctioneer owes to the principal the duty to act in accordance with his instructions,to describe the property accurately,not to sell the property below the reserved price,to secure a binding agreement and obtain the money,to care for the property;owes to the bidder and the buyer the duty to tell the defect of the property,to secure the fair competition,to deliver the property and transfer the ownership,to warrant the defect;owes to the third party the duty to respect the ownership and other right of his,to secure the safe of the third party.
