行刑社会化的内在逻辑合理性解析

行刑社会化在我国必将得到进一步的普及和推广.本文在比较分析了目前有代表性的几种行刑社会化概念后,认为行刑社会化是为了弥补监狱行刑方式的缺陷,充分体现现代刑法确保人的价值和社会的价值统一的精神,对条件合适的罪犯适用非监禁刑,使其在社会上得到教育改造,并使社会最大限度地参与罪犯矫正事业,从而使刑事执行与社会发展同步,为罪犯顺利回归社会创造有利条件的一种行刑方式.文章接着从罪犯改造的目的性、可能性、正当性三个方面分析了行刑社会化的内在逻辑合理性.

Analysis of Logic Legitimacy of Socialized Punishment

Socialized punishment is inclined to popularize in China.Through comparisons among several typical concepts of socialized punishment at present,the paper holds that the socialized punishment is a supplement to the imprisoned punishment,which manifests the spirit of the integration of person value and socity value that is ensured by modern criminal law.Those criminals whose conditions adapt to non-imprisoning can be educated and reformed in society.It makes the society to the largest extent participate in the cause of criminal remold so that the criminal punishment will be simultaneous with social development,and therefore it will act as the catalysis for the criminals to return to society.The paper then analyzes the logic legitimacy to socialize punishment from three aspects including objective,posibility and reasonableness.
