| 摘 要： | 《政府信息公开条例》自身的不足和其他外部法律制度的缺陷构成了当前政府信息公开的主要障碍。公开与保密之间的逻辑矛盾、制度安排之间的冲突,成为制约信息公开的制度因素;司法对知情权保障不足,官员保密思维的传统,构成制约信息公开的外部环境。要让政府信息公开得更加顺畅,就必须从当前的制度实践出发,着力解决《政府信息公开条例》第八条的逻辑矛盾、《保密法》与《政府信息公开条例》的衔接、档案信息的公开、信息公开的司法审查等问题。
