| 摘 要： | 确立非法证据排除规则不仅是保障人权、维护法治尊严的需要，而且还能够促进发现案件的实体真实。我国刑事诉讼法和相关司法解释对非法证据排除问题的规定存在缺陷，与刑事诉讼的现代化、民主化潮流不尽相符，也是滋生非法取证的根源之一。在现有立法和司法解释的基础上，我国应对非法证据排除规则加以改革和完善，并建立起相关的配套程序机制。
