配偶权法律性质新论

配偶权分为人身性配偶权和经济性配偶权.它们在内涵上均指向婚姻的共同生活,在外延上则指向与婚姻共同生活相关的一切权利义务.平等合伙型夫妻关系既是配偶权的产生的基础,也是理解配偶权法律性质的前提.从法律结构来看,人身性配偶权对内指向类似自然之债的关系.配偶双方的意愿在人身性配偶权中具有绝对地位,并决定人身性配偶权在对外关系中是否具有绝对性.经济性配偶权对内指向请求权关系,但在对外关系中却具有绝对性.

New Exploration on the Nature of Conjugal Rights

Conjugal rights can be categorized into two types： status rights and economic rights. The connotation of conjugal rights refers to the marriage consortium while the denotation indicates all potential rights and duties. Conjugal relation based on equal partnership is not only the foundation of conjugal rights but also the premise of analyzing the nature of conjugal rights. From the perspective of legal structure in status right, its internal relation resembles that of obligation naturalis. It does not imply an erga omnes right. It is the will of spouses that determines its nature in external relations. Compared with the status right, the economic right has different legal structures. On one hand, it indicates claim-duty relation from the point of domestic relations, on the other hand, it is an erga omnes right from the perspective of external relations.
