| 摘 要： | 从冲突法的角度对海峡两岸侵权案中“弱者”的保护进行了比较研究,指出当前两岸保护“弱者”的方法只有实体法的方法,缺乏冲突法的方法。其结果是对“弱者”的保护不规律、不完整、不深入、不奏效,并在此基础上提出具体的立法建议。

| Abstract: | The essay makes a comparative analysis on the protection ways for "weak person" in the tort by the conflicts laws of two-sides of strait,and finds that both sides just have substantive ways to protect "weak person".The results of lacking the conflicts law ways are: the protection ways are not in order,not complete,not deep and not effective.So the essay studies mainly on the weakness of the conflicts laws of two-sides of Strait,and points out concrete legislative suggestions. |
