文化创意产业的内在本质和知识产权的自身特点,共同决定了文化创意产业知识产权保护体系的内容架构。文化创意产业知识产权保护体系的建构,应该以版权法为核心,兼用专利法、商标法、商业秘密法和反不正当竞争权法。充分获得并有效保护各种形态的知识产权以促进文化创意产业的发展,是知识产权保护体系建构的出发点和归宿。政府职能部门、行业协会和创意企业应该各自发挥其职能,共同推进文化创意产业知识产权保护体系的科学建立和有效运作。

On Construction of Intellectual Property Protection System of Cultural and Creative Industry

The nature of cultural and creative industry and the characteristics of intellectual property rights,jointly determine the content of the intellectual property protection system in cultural and creative industry.In the construction of composite intellectual property protection system,the copyright law should be the core,with patent law,trademark law,trade secret law and anti-unfair competition law as the auxiliary factors.How to obtain and effectively protect various forms of intellectual property rights to promote the development of cultural and creative industry,have been an essential problem in the composite intellectual property strategy.In order to jointly promote the establishment and effective operation of the composite intellectual property strategy,the government,industry associations and creative enterprises should play their respective functions.
