摘    要:集体劳动争议是我国集体劳动关系调整中的基本问题。虽然已经大量出现劳动法传统意义的、利益争议为主的集体劳动争议,但在法律制度上,现行劳动争议处理机制中的集体劳动争议不过是个别劳动争议的累加,缺失以利益争议为调整对象的集体劳动争议处理机制。为此,重构集体劳动争议机制是社会立法的重要课题。重构的基本思路是:在整合《劳动合同法》、《集体合同规定》的基础上,制定《集体合同法》;完善《工会法》,建立不当劳动行为等制度;修订《劳动争议调解仲裁法》,在完善权利调整为主的个别劳动争议机制的同时,构建利益争议为主的集体劳动争议调解仲裁制度。

Abstract:Collective labor dispute is the basic problem of the collective labor relation adjustment in our country.At present,there are many problems about the system and practice on the settlement mechanism of collective labor dispute.The basic thinking of reconstructing collective labor dispute mechanism should be based on Labor Contract Law,Collective Contract Provisions and be integrated into establishing Collective Contract Law;perfecting Trade Union Law and establishing the mechanism of improper labor practices;revising Law of the People’s Republic of China on Mediation and Arbitration of Labor Disputes;and constructing the mediation and arbitration system on collective labor disputes.
