| 摘 要： | 宪法是国家与社会关系的最高法律整合.正义作为最重要的法哲学价值必然介入到此种整合中.正义介入之方式,相当程度上决定了被介入的宪法之法哲学价值和正义自身价值实现的大小.中国1975年宪法以其特殊的正义介入方式,使该部宪法进入了罗文斯坦所称之规范性宪法行列.同时,以实驭虚的正义观与正义实践,亦使正义得到了效果颇佳的特殊实践阐释.

| Abstract: | Constitution is the combination of all highest laws concerning a nation and its society. Carrying the most important value in the sense of juristic philosophy, justice can not be avoided in this combination. The way that how justice becomes a part of it, to a great degree, determines how much the value of juristic philosophy and the value of justice itself can be implemented. The particular way that justice stepped into the 1975's constitution made this constitution one of the standard constitutions in Rovenstein's term. In this constitution, justice was effectively explained by practice. |
