摘    要:善意取得是各国民法物权法上的一项重要的法律制度,其创设的目的是为了对绝对主义所有权原则设立一种限制。本文对我国不动产善意取得理论存在的分歧进行分析,指出其理论存在的不足,并从利益失衡论、物用优先论和法益保护说角度出发,阐发了不动产善意取得的理论基础。

Abstract:The system of acquisition in good faith is a very important legal system of civil law and law of jus ad res in the world, whose aim is to enforce a restriction on the protection of absolute ownership. The thesis is to ponder over and criticize the traditional system of acquisition in good faith from constitutive requirements with an analysis of the divergence and defects of current theories, and, more importantly, seeks to elaborate the theoretical basis of the acquisition of real properties in good faith from the theory of unbalanced benefits, the theory of priority on the utilization of res and the theory of protection of legal interests.
