论我国刑事简易程序的完善

自20世纪60年代以来,随着西方经济分析法学的兴起,法律程序中的经济效率问题逐渐受到了各国学者的重视。诉讼程序简易化和简易程序多样化已成为刑事诉讼程序立法和发展的基本趋势。我国现行刑事诉讼法所确立的刑事简易程序存在适用范围狭窄、形式单一、对当事人主体地位尊重不足等多方面的问题,应在认真总结我国刑事诉讼立法和司法改革经验与教训的基础上,充分借鉴世界各国的成功经验,对其进行包括程序本身设计和配套制度建立在内的全方位完善。

On the Improvement of the Criminal Summary Procedure in China

From 1960s-1970s, with the rise of law science of western economic analysis, the economic efficiency question in the legal procedure is paid attention to by scholars of various countries gradually. The facilitation of the contentious procedure and the diversification of the summary procedure have already become the basic trend of the legislation development of the criminal procedure. The criminal summary procedure in the current criminal procedure law of our country has problems in many aspects- the scope of application is narrow, the form is single and respecting to party's subject position is insufficiently etc. On the basis of summarizing criminal procedure legislating and judicial reform experience and lesson of our country conscientiously, using successful experience of countries all over the world for reference fully, we should perfect the procedure omni-directionally including procedure design itself and the building of the related system.
