中国信访制度的回顾与展望

中国当代信访制度的雏形出现于上世纪五十年代初,从那时起它作为表达民愿、参与政治和解决纠纷的一种特殊手段,在化解社会矛盾、稳定社会秩序方面发挥了重要的作用。信访制度是中国特有的一种人权救济方式,它的功能也是随着时代发展而不断变迁。但是近几年来,由于信访体制不顺,机构庞杂;信访功能错位,责重权轻;信访程序缺失,立案不规范以及信访人的法律救济意识淡薄等诸多原因,致使信访作为一种非诉救济方式却很难再实现其化解纠纷、救济权利的目的。因此,在新的历史条件下,需要对信访制度进行必要的反思和重构,不断规范信访制度,通过对中国古代、近代信访制度的考察,进一步探讨中国信访制度的运作模式。
