西方古代自然法学说与《韩非子》思想之比较

《韩非子》中法令因循道理自然的主张,与西方古代自然法学说设立高于人定法的自然正义(NaturalJustice)有显著差异。西方古代自然法学说的自然正义能够评判现行法可否具备法律效力,含有永恒不变的确切内容及伦理道德上固定的价值倾向。《韩非子》的道理自然无力评判现行法效力。其学说亦不含永恒不变的确切内容与伦理道德上固定的价值倾向。这一定程度上反映了中国传统思维与西方逻辑思维的差别。

A Comparison between Natural Law in the Greek and Roman Period and the Thought of Han Fei Zi

Both the thoughts of Han Fei Zi and Natural Law in the Greek and Roman period claim that the human-made laws should follow certain principles.But from other angels,there are many differences between them.For example,the theories of Natural Law in the Greek and Roman period claim that those human-made laws,which go against Natural Justice,should not have their validity.They also claim that Natural Justice is eternal.While Han Fei Zi suggests that "Dao","Li"and the nature cannot judge the law's validity.Yet is there no eternal principle in the thought of Han Fei Zi.We can find the differences between the deductive inference from the Western and the historical reason in traditional China.
